Judge grants summary judgment favoring archdiocese in Sacred Heart demolition suit, city dismissed without prejudice

City Attorney Steve Tomlinson updated the Roseville City Council on litigation concerning the demolition of the Sacred Heart Church, saying a judge had granted summary disposition in favor of Mooney Investments and the archdiocese.
Tomlinson reported this afternoon’s opinion resolved the second filing against the demolition. "Judge Drazinski issued an opinion in order and granted the motion for summary disposition in favor of, Mooney Investments or the archdiocese," Tomlinson said. The city was dismissed without prejudice in that filing and related motions for summary disposition continued in the case against private parties.
Tomlinson told the council he expected Harvest Time Church, which had filed the suit, might consider an appeal but did not state that an appeal had been filed. He offered to answer questions from the council, and none were recorded beyond a brief acknowledgement.
What’s next: The matter as reported is closed at the trial-court level for the referenced filing; any appeal or further motion practice would be determined by the plaintiff (Harvest Time Church).
