Madison County to seek chancery-court order after resident says property sold in tax sale without notice

Tamika McLauren Hamlin told the Madison County Board of Supervisors that her late mother’s property was sold in a tax sale and that heirs were not properly notified. "My mom's property was sold in a tax sale," Hamlin said, adding she learned only recently and had already paid a private lawyer $1,500 to look into the matter.
County attorney Mister Lott told the board the county’s research shows the redemption period has passed and the county cannot unilaterally set the sale aside. He said the board’s recourse is to file a chancery-court suit asking a judge to cancel the sale and order reimbursement to the tax purchaser with interest. "We'll go to chancery court and file an action intended to get the judge to order us to set aside the land sale," Lott said. He also said he would not recommend that the board pay Hamlin’s private legal fees.
Board members confirmed they had previously discussed the issue and that the minutes’ approval was required before the county could move forward. Supervisors instructed staff to proceed with the chancery-court filing and to attempt to expedite the matter. The county attorney said the purchaser never completed confirmation in chancery court, leaving a path to contest the sale in court.
Next steps: the county will file the chancery-court action, seek a judicial order to set aside the sale, and plan to reimburse the tax purchaser with interest if the court so orders.
