The Lake County Planning Commission on Aug. 11 recommended approval of a conditional-use permit for an accessory dwelling unit (ADU) at 138 Lynn Street in Twin Lakes Village, concluding that the application meets the approval criteria in the Lake County Land Development Code.
Planning staff described the property as a 0.24-acre parcel with a primary residence and an ADU that was retrofitted to bring it into zoning compliance. Staff said the on-site wastewater treatment system (OWTS) permits occupancy for a one-bedroom unit of up to two people and emphasized that the permit conditions must reflect that limitation.
The commission attached five conditions to its recommendation: secure the septic tank lid, make the parcel address visible from the adjacent road, install smoke detectors wired on a relay system, install carbon-monoxide detectors in accordance with Colorado law, and limit the ADU to one bedroom occupied by no more than two people. Shalom Kaiser, the applicant, told the commission he had nothing additional to add beyond the application materials.
Commissioner Joey Edwards moved for the recommendation, citing staff findings that the application met section 3.6.1.f of the land-development code; the motion was seconded and approved by voice vote.
The commission closed the evidentiary portion of the hearing before voting. No public speakers registered for this application at the Aug. 11 hearing. The planning commission's recommendation will be incorporated into the official record and forwarded as required by county procedure.
