BOCC agrees to three‑month extension of Maker Housing Partners IGA ahead of study session

County staff asked commissioners to extend an intergovernmental agreement (IGA) with Maker Housing Partners that assigns certain rights created by HB‑24‑1175 for local governments to purchase and preserve affordable housing. The original IGA was countersigned in September and was due to expire at the end of the calendar year; staff requested more time because only a short operational period has elapsed since execution.

Ben (staff) told the board the IGA assigns the right of first refusal for properties that previously received public subsidy to Maker and vests the county with a right of first offer process for market‑rate acquisitions that could be turned into deed‑restricted affordable housing. Commissioners asked for clarity on the right‑of‑first‑offer process, transparency to property owners about potential encumbrances and the IGA’s operational workflow. Staff said they will present additional graphics and a study session that lays out the vetting process and reporting responsibilities.

Given open questions, commissioners agreed to a three‑month extension so staff can return with a full study session and more detailed materials before deciding on any longer extension or policy change. Staff said the extension will preserve the partnership while allowing public review and improved transparency materials to be prepared.
