Rhonda (parks and recreation) explained that, in practice, heavy or wet snow and repeated storms can make immediate trail clearing inefficient and that staff should be allowed to prioritize critical infrastructure and public-safety facilities. She described a three-tier priority: Priority 1 for critical facilities (police, city hall, library), Priority 2 for sidewalks, and Priority 3 for trails and bridges (SEG 623–683). Rhonda said the policy is intended to save staff time and to allow staff to make situational judgments: "It's just giving us your blessing to say, you guys make the call, and and we'll do the best job that we can" (SEG 668–670).
A councilmember asked whether leaving trails uncleared could increase legal liability; staff and the city attorney explained applicable sidewalk case law (Bankers Trust case referenced) is sidewalk-specific and would not automatically extend to trails without a court decision (SEG 707–719). Councilmembers discussed public communication and agreed staff should publicize the new guideline so residents understand why a trail may not be cleared immediately (SEG 671–674).
The council moved to approve Option 1 (staff discretion with the described priorities), a second was recorded, and the motion passed (SEG 727–732). Staff were directed to publish the guideline for public information.
