Wheatland council approves five-year, nonexclusive full-attachment agreement with Visionary Communications

The Wheatland City Council voted to approve a nonexclusive full-attachment agreement with Visionary Communications, moving the term from two years to five and increasing the town's per-attachment fee from about $10.10 to $12.00.

Kyle Farley, director of regulatory affairs for Visionary Communications, told the council that the amended contract reflected a longer term and a fee adjustment and said he helped draft the agreement with the company's representative Preston. "I'm Kyle Farley with the, Visionary Communications. I'm the director of regulatory affairs. I helped draft the agreement with, Preston," Farley said as he described the proposed changes and offered to work with town staff on implementation.

Council discussion focused on resident notice and how attachments and future fiber work would be communicated. A council member summarized constituent complaints: "They didn't know where they were gonna be putting stuff on easements," and urged clearer advance notification. Town staff and the Visionary representative said the agreement now includes an application procedure that will give the town a chance to review proposed attachments before permits are issued and that contractors could be instructed to notify residents directly.

Supporters said the change gives the town greater oversight as fiber is extended across Wheatland, while keeping the agreement nonexclusive so other companies may attach where appropriate. After brief discussion the council moved, seconded and approved the full-attachment agreement by voice vote. The motion carried with no recorded opposition.

The vote authorizes staff to finalize the nonexclusive five-year agreement and to apply the new fee structure; council members said they expect improved contractor outreach to address resident concerns about location and easement notice.
