Stuart moves Flagler Center lease to align Main Street agreements; cautions about 10-year referendum requirement

The City Commission approved Resolution 101-2025 on Nov. 24 to amend the lease between the City of Stuart and Stuart Main Street Association Inc. for the Flagler Center at 201 SW Flagler Avenue. Staff proposed adding nine months to the final three-year renewal term so the lease renewals for several Main Street agreements fall in the same fiscal-year window.
Mr. Baggett (staff) explained that the lease has an initial three-year term with two possible three-year renewals and that adding nine months to the final renewal would align the Flagler Center lease with three other Main Street agreements that otherwise renew at different times of year. "By doing it that way, when they come up, they're gonna be on the same all gonna be at the same time," Baggett said while summarizing the intent to align renewal dates with the city's fiscal year (Oct. 1–Sept. 30).
Baggett also reminded the commission of a charter constraint: "if we have to lease any property in the city of Stuart for more than 10 years, we have to go out for referendum and have the population vote on it." Staff said the change being approved would not yet trigger a referendum but warned commissioners to be mindful of the ten-year limit on future renewals.
Commissioner Clark moved approval of Resolution 101-2025, and Vice Mayor Collins seconded. The commission approved the resolution by roll call vote, with all voting yes.
The amendment will result in the Flagler Center renewal aligning with the Market on Main Street license and other Main Street agreements on the city's fiscal calendar; staff said all agreements will be presented together for review in years when multiple renewals coincide.
