Staff presented a redline and a draft resolution recommending readoption of local ADU provisions consistent with state law while preserving Fairfax‑specific design standards where allowed.
Several commissioners raised technical and policy questions: the redline available at the hearing did not show the new interior‑livable‑space definition the presentation relied on; one commissioner flagged a 30‑versus‑31‑day reference for the short‑term‑rental definition; another asked for clearer language about whether adding a JADU can trigger a sprinkler requirement for a primary dwelling. Commissioners also asked staff to correct typographical cross‑references and to confirm the ordinance is transmitted to the state Housing and Community Development department within the statutory 60‑day window.
Given the missing redline items and requested clarifications, the commission voted to continue the ADU ordinance item to the next meeting and asked staff to place it early on the next agenda so commissioners and the public have adequate time to review the corrected redline before recommending the ordinance to the town council.
The commission noted the town’s incentive and amnesty programs for legalizing unpermitted ADUs remain in place under the current urgency ordinance and that staff will return with a corrected draft addressing the technical comments.
