Chesapeake Council approves several land‑use requests and passes Patriots Walk proffer revision 5–2

Public hearing approvals adopted unanimously (8–0) included: PLN PUD C 2018‑5 (The Grove at Western Branch) to allow conversion of up to 200 previously approved senior residential units for independent living, assisted living, or memory care with amended development criteria dated May 23, 2025; PLN USE 2020‑515 (Dandy Bros Tattoo) for a conditional use permit at 910 Great Bridge Boulevard with stipulations dated July 14, 2025; PLN USE 2025‑027 (Hutter Daycare) for a Level 2 home‑occupation daycare at 1082 Washington Drive with stipulations dated July 11, 2025; and PLN USE 2025‑026 (Hickory Towing) for a 70‑by‑40‑foot storage building at 3511 Business Center Drive with stipulations dated July 14, 2025.
During new business, the council considered PLNREZ 2021‑3 (Patriots Walk accelerated proffer modification). Planning Director McNamara told the council the proposed modification aligns with the comprehensive plan and staff recommended approval with amended proffers dated Aug. 28, 2025. Council member Whitaker disclosed a personal interest and was disqualified from participating. A motion to approve the revised proffers passed 5–2.
Council members indicated they will research adding a question to the application process to capture any private agreements between applicants and citizens after Council member Newlands raised concerns about unrecorded promises from applicants that are not enforceable unless memorialized in proffers. The City Attorney said staff will research how other localities handle the issue and provide guidance to council.
