Commission disapproves Morgan Farms final plat after developer misses conditions

The Planning and Zoning Commission voted on Jan. 15 to recommend disapproval of the final plat for Morgan Farms Phase 1 (Plat 20 5-4), citing unmet conditions attached to an earlier conditional approval.
Staff told the commission the final plat covered roughly 43.246 acres east of County Road 642 and north of West Hubbard Road and would create 211 residential lots and six common areas (the transcript lists "2 11" residential lots; staff explained this refers to 211 lots). Two conditions remained outstanding: completion/acceptance of public improvements and abandonment of an easement on the west side of the property. The city council had been unable to act on the easement abandonment because the ordinance was omitted from the council agenda, and staff therefore recommended that the commission disapprove the final plat until the conditions were satisfied.
A commissioner moved to recommend disapproval on the grounds that the conditions had not been met; the motion was seconded and approved by voice vote. Staff said the developer can submit a written response and the plat can return for consideration when the conditions have been satisfied; staff expects the easement abandonment to be placed on the City Council agenda for Feb. 9.
