Board approves district legal representation list after debate over who may contact counsel

The Prior Lake‑Savage Area Schools Board debated item 6e—naming the school district's legal counsel—before approving the recommended list Jan. 12. The exchange centered on whether individual board members or a board majority may initiate contact with legal counsel or whether the superintendent should continue to serve as the conduit for legal requests.
Director Atkinson asked for clearer language, saying the way the policy is written "doesn't give us the authority" for the board majority to engage counsel and asked that "different administrators" be authorized if the board needed legal advice. Doctor Thomas and other directors explained that, by practice, legal requests are brokered through the superintendent and that MSBA provides legal guidance but does not replace district counsel for an independent district.
A number of directors emphasized concerns about individual board members directly contacting counsel (and incurring fees) and noted a quorum‑level request is the customary practice. After discussion, a motion to approve the district representation and authorized contacts passed on a roll call, 7–0.
The board did not adopt the textual amendment Director Atkinson proposed during the meeting; instead, members confirmed current practice and commitment to follow Robert's Rules and to coordinate legal contacts through the superintendent when appropriate.
