The Village of Depew Zoning Board of Appeals unanimously approved a variance allowing Deborah and Michael Anderski to replace a decayed rear deck at 258 Calumet Street with a slightly larger composite deck. The board clarified the request concerned proximity to the property line and set the minimum relief at 3 feet.
Deborah Anderski said the existing wooden deck had decayed and the new composite deck will extend approximately 8 feet across the rear and 9 feet back to the house. "So we are replacing our deck and it's a little bigger than the one that was there before," Anderski said. Michael Anderski confirmed the prior deck had sunk and that the new structure will be more durable.
Staff explained the variance is necessary because the deck will come closer than the usual five-foot setback and that the relief sought is for distance from the property line rather than the total size of the deck. After the chair read the state's six area-variance criteria and reviewed the applicants’ answers, Member Yarborough moved to grant the variance; Member Galvin seconded. The roll-call vote was 4–0 in favor.
Board members and staff instructed the Anderskis on next steps: the board's approval allows the village to issue the building permit, and the applicant should coordinate with Schuster Construction (the contractor noted in the application) to file for the permit and begin work.
