The San Juan County Commission approved an agreement to pool Monticello City justice-court revenues/expenses and split net costs 70% county / 30% city after related expenses; the county attorney's office said implementation efficiencies are expected and attorney workload compensation will be addressed through the budget process.
San Juan County commissioners approved an intergovernmental agreement on Jan. 20 to formalize cost sharing with Monticello City for justice-court matters.
Deputy County Attorney Nelson summarized earlier work: justice-court receipts and expenses from Monticello City would be combined to cover court-related costs, and net expenses would be split with 70% borne by the county and 30% by the city after allowable expenses are deducted. "Anything related to justice court from Monticello City, it's in one pot like this... and then after those expenses, there's a 70/30 split between the county and the city," Nelson said.
Nelson told commissioners that the agreement had been negotiated and only a few minor changes remained from prior sessions; from the legal department's view the contract was ready for approval. Commissioners clarified that compensation for added attorney workload would be handled through the county's budget process, not through the contract approval.
A motion to approve the contract was moved, seconded and approved by voice vote. Commissioners said the agreement should bring efficiencies to justice-court functions while noting any county attorney staffing or budget impacts will be resolved in future budget decisions.
