Building committee presses for clarity after Select Board executive session on West Main Street litigation

Members of the Northrop Fire Station Building Committee pressed for more information after the Select Board announced it had convened an executive session to "discuss the initiation of litigation" connected to 61–65 West Main Street, the site of the new fire station.

The committee’s chair said the executive-session notice, posted by the Select Board chair, surprised committee members who have been overseeing construction and asked whether any litigation would affect the project budget. "If something's in litigation, it costs money — is this gonna be a reflection on our budget?" the chair asked.

Mr. Jones and other representatives said they could not disclose deliberations held in executive session. Mr. Jones cited M.G.L. Chapter 30A, Section 21 as the statutory authority that allows municipal boards to meet in executive session for legal advice and other specified purposes, and stated counsel likely advised the Select Board on the agenda wording.

Committee members said their chief concern was not the fact of legal advice but that the body charged with overseeing construction had not been consulted or briefed. One member said the committee had worked on the project for years and noted, "This board was excluded from any discussion on the litigation."

Representatives reiterated that executive-session content is confidential and that the committee would be briefed only to the extent permitted by counsel or once disclosure is allowed. No estimate of possible legal costs or budgetary impact was provided at the meeting.

The committee did not take formal action on the matter; members asked staff to flag whether any future legal developments could affect contingency funds and to notify the committee if a disclosure consistent with legal advice becomes possible.
