Accomack County Wetlands Board members voted to ask the County Attorney for guidance on an outstanding in‑lieu mitigation fee tied to a bulkhead project for Raymond and Julie Burke.
Staff told the board the Burkes had moved to Captain's Cove and discovered the $1,620 in‑lieu fee after seeing the online agenda; the Burkes submitted a letter and a contract that staff said shows the owners would owe that amount. Staff explained the county issued an initial building permit at the time without securing the payment and that mitigation policy changed between the Burkes’ two permit actions (from $12 to $18 per square foot in the board’s assessment). Staff recommended contacting the property owners at their new address and reporting back after consulting legal counsel.
A board member moved that the board request County Attorney guidance; the motion was seconded and approved by voice vote. Staff said it would notify the Burkes that the fee appears owed and would seek direction from the County Attorney on enforcement options.
Separately, staff reported multiple conversations with a Mr. Buckland, who said he lives out‑of‑state and is not in a position to pay an outstanding $960 mitigation obligation; staff said it was consulting the County Attorney on next steps for that case as well.
