Texarkana board adopts ordinance to file for ward-based elections, attaches emergency clause

The Texarkana Board of Directors voted Dec. 2 to adopt an ordinance declaring the cityintent to elect its board of directors by ward and to file the ordinance with the Miller County clerk as required by Act 283 of 2025.

Staff said the measure is largely procedural and recommended passage after noting conflicting attorney guidance about whether the statute applies to cities with a city-manager form of government. One board member repeatedly questioned applicability, saying municipal-league advice he received indicated it might not apply to their form of government. City staff and other board members said adopting the ordinance is an "abundance of caution" that does not change how members are chosen today.

"This is just formality," a staff presenter said, adding the ordinance "confirms what we do anyway." After the ordinance was read in title on first, second and third readings, the board moved and seconded to adopt. A roll-call vote recorded yes votes by the directors present and the ordinance was adopted.

Shortly after adoption, the board voted to attach an emergency clause so the filing with the county clerk could proceed promptly.

The ordinance text and staff remarks cited Act 283 of 2025 as the statutory basis for filing with the county. Several board members asked staff to continue clarifying whether the statute's requirements differ by municipal form of government and to provide any written municipal-league guidance the city received.

The board did not vote on any change in election method at this meeting beyond the filing and declaration of intent. Staff said adopting the ordinance now preserves the cityoption to continue at-large elections later if the board chooses.

The ordinance was adopted by recorded roll-call votes; the board also voted to attach the emergency clause.
