Council to consider annexation agreement with Bethel Township that waives TIF compensation and seeks boundary conformance

Huber Heights staff on Dec. 2 briefed council on a draft annexation agreement with Bethel Township that staff said is intended to resolve overlapping incentives and clarify responsibilities for newly annexed Carriage Trails parcels.
Planning staff said the township will remove the existing TIF overlay on the recently annexed property and agree to waive compensation payments that, under state statute, could total roughly $600,000–$700,000 over the life of the statutory payments if the parties did not reach an agreement. "This agreement for us not facilitating the annexation ... the township Bethel Township would waive those compensation payments," Aaron said at the meeting.
As part of the same package, staff said they will petition Miami County to conform township boundaries to remove the township from the recently annexed parcels, which Bethel requested. Staff estimated the county process could take about 30 days after filings. The city also would agree not to facilitate annexation of properties north of SR 40 (and effectively east of SR 201) for 20 years as part of the deal.
Staff asked council to move the resolution and related boundary-conformance petition to Monday's agenda for final action. Council had clarifying questions about the extents referenced in the agreement and staff provided map‑based clarifications.
