The Warren Zoning Board of Appeals voted Jan. 14 to deny a use-variance request to allow permanent-makeup services in Suite 3 of a Mound Road office building.
Owner representative Assad Soba and a translator for the prospective operator described procedures as 'permanent makeup' — micropigmentation for eyebrows and lips — that they said penetrates only the top layer of skin and generally fades over months.
Multiple board members, citing their review of state rules, said Michigan treats permanent cosmetic procedures as a form of tattooing and that a granted C2 use would run with the parcel and could allow other tattoo or piercing operations later. "If we grant this variance, the next tenant can come in, and we've granted a variance of our tattooing," said one member during the hearing.
Legal counsel and staff said the variance could be limited to Suite 3 if the board chose, but several members said the public-safety, licensing and neighborhood-proximity concerns and the availability of existing zoning made denial the correct option. Mr. Lindsey moved to deny and the board voted to deny by recorded voice vote.
