Rodney Clemmicks, co-owner of the property at 5330 Moffett Road, withdrew his holdover conditional‑use application at the Mobile City Planning Commission meeting on Jan. 15 after staff said the project lacked a revised site plan showing compliance with the city’s Unified Development Code.
Staff advised commissioners that the application had not demonstrated conformance with Article 3 of the UDC and the specific conditional‑use criteria in Article 5 §6(e). Clemmicks told the commission he had submitted a plan but acknowledged it was not in the required format and said he was coordinating with outside help to bring the submission into compliance. “We did submit a plan, but it wasn’t in guidelines,” Clemmicks said.
Consultant Patrick Garcecki, who said he had inspected the site, recommended withdrawal and resubmission with enough time to complete required revisions. Commissioners described two options: deny the application (which could be appealed to the city council) or allow the applicant to withdraw and resubmit; staff clarified that withdrawal would permit a six‑month window for resubmission from the date of withdrawal. The applicant chose to withdraw; the chair announced, “Application is withdrawn.”
Commissioner Josh Woods, the city‑council representative on the commission, said several questions remained about the proposal, including the number of residents, parking and staffing, and urged the applicant to address those issues before returning. The commission took no vote on the substance of the permit because the application was withdrawn.
