City staff updated the Verona Common Council on progress at the Whispering Coves development and the council voted to authorize staff to draw on the project's letter of credit if the developer fails to complete outstanding public improvements after formal notice.
City staff reported that FDG/Parisi completed sluice gates and hatch covers and finalized an access agreement for part of the scope, while construction of some pavement remains outstanding and some installed pavement is beginning to fail in spots. Public works staff said some repairs would be weather‑dependent and likely deferred until spring; staff and the city attorney reminded the council that the development agreement and guarantee periods allow the city to identify deficient public improvements, issue notice, and — if the developer does not act within the contract time — draw on the letter of credit to complete the work.
Alders moved and seconded a motion authorizing city staff to pursue drawing on the Whispering Coves letter of credit for development‑agreement work that is not timely completed after notice; the motion passed on a council voice vote. Council members emphasized preference for compliance but said the letter of credit is the available enforcement tool if the developer does not finish required public improvements.
No draw was executed at the meeting; staff indicated they expect to reassess the work next spring and to give developers the contractual notice and cure opportunities before taking enforcement action.
