The Township of Washington Zoning Board approved Resolution ZB 2516 on a roll-call vote to extend Resolution ZB 2419 for a proposed single-family home at 662 Jefferson Avenue, Block 3102, Lot 9. The extension is subject to the terms and conditions in the original approval and to the submission of revised plans to the board engineer prior to any permits being issued.
Chairman Getz moved to approve the resolution and said he would follow up with the building department and the applicant; he said the board will CC the applicant on written follow-up and that “no permits shall issue until the revised plans are submitted as was discussed as a condition of the extension.” Board engineer John Nikkiewicz told the board that, while proof of ownership (a recorded deed and certificate of formation) had been provided showing a change of ownership, the revised plans required by the original resolution had not been submitted.
During extended discussion board members debated whether the board could withhold approval of an extension if conditions from the original resolution remained outstanding. Attorney Gary Pantonio cautioned that the board’s legal authority to refuse an extension under the statute may be limited and that voting down an extension could invite litigation. Members settled on approving the extension while recording the outstanding condition and instructing staff to obtain the missing plans in writing.
