School legal counsel and presenters told the board the engagement is contingency‑based: the district would not pay attorneys’ fees unless the litigation produced a monetary recovery, and any fees would be deducted from recovery amounts. Counsel said participating now gains the district a seat at the table with lead plaintiffs and would allow PCSSD to supply factual information (budget and program cost data tied to student mental‑health and behavioral services) the plaintiffs allege are damages tied to social media platforms’ design and algorithms.
Presenters said the litigation focuses on large platform companies named in the filings and relies on peer‑reviewed studies and whistleblower testimony. Counsel said the firm leading the effort (included in the packet) will prepare a fact sheet using district records; presenters emphasized no student private data would be provided in that process.
Board members asked about cost risk and timeline. Legal counsel said there is no up‑front cost to the district under the proposed engagement and that the district is already part of the certified class; the decision to sign the engagement secures participation and potential priority in settlement distributions if a recovery is achieved.
A motion to sign the engagement letter was made, seconded and passed 5-0.
