Public Safety Commission approves implementation plan to expand Texas Compassionate Use Program under House Bill 46

The Public Safety Commission approved a plan to expand the Texas Compassionate Use Program to 15 licensees, the commission said at its August meeting.

Chief Wayne Miller, chief of the Regulatory Services Division, told commissioners the legislature directed the department to add 12 licensees to reach a total of 15 and to use a competitive, scored selection process to decide which applicants receive licenses under House Bill 46. "The legislature has now said this program is to have 15 licensees and so we need to add 12," Miller said.

Miller said the expansion will be executed in two phases. The department will prioritize applications already on file from 2023 for the first nine new slots; those applicants may supplement but not wholly rewrite their prior submissions. A dual application window opens August 8 and closes September 15, 2025; phase‑1 applicants can submit limited supplemental materials, and new applicants can submit fresh applications during the same period.
