The City of Bellaire Planning and Zoning Commission on July 10 voted unanimously to recommend amendments to the city code regulating the Urban Village Downtown (UVD) district and sent a formal recommendation memo to City Council.
The recommendation covers several substantive changes included in the commission’s packet: making multifamily development in UVD allowable only through a planned development (PD) application rather than by right; reducing maximum building heights for PDs (the packet shows a proposed reduction from 79 feet to 53 feet for applicable PD projects); adjusting the street‑facing yard standard for very shallow parcels; and replacing references to “church” with the term “place of worship” to match recently amended Chapter 24 language. Commission materials also show an adjustment to the treatment of rear/back‑lot building height: the packet records a rear‑lot threshold (the height at which a setback plane applies) of 17 feet in some circumstances.
The changes were presented as part of the city’s ongoing effort to implement recommendations in the comprehensive plan and to align UVD standards with other recent code updates. The commission’s staff recap noted that the amendments were discussed at a public hearing on June 12 and that no public comments, written or in-person, were submitted for this item during that hearing.
After a brief period for commissioners to ask clarifying questions — including confirmation that the rear/“backlot” threshold had been lowered to 17 feet — Chair (unnamed) moved that the commission recommend the UVD amendments to City Council “as stated in the materials that were sent to us.” The motion received seconds and passed unanimously. The commission also approved the standard transmittal letter, which will accompany the proposed code language when staff sends the item to City Council.
Commission staff and the packet highlight the reasons behind the changes: to reduce potential building scale adjacent to lower‑rise residential areas, to clarify permitted uses and definitions, and to provide relief for very small parcels on street‑facing yard requirements. The commission’s action is a recommendation only; City Council will consider the ordinance language and may amend it before any change becomes law.
The commission’s packet and the motion record will be included with the council transmittal. Staff indicated the item will be scheduled for City Council consideration as the next step.
The commission also approved a separate procedural letter to City Council that will attach the full proposed UVD code amendments.
