Commission approves accessory building with ADU in Foothill Estates

The Eastern Summit County Planning Commission approved a conditional use permit and final site plan for an accessory building and accessory dwelling unit at Foothill Estates Phase 1, Lot 2 (Stockley property).
Planner Tiffany presented the application, noting the lot is approximately 1.94 acres in AG-10 and the accessory building would total about 3,698 square feet with an upper-level accessory dwelling of 998 square feet and a 510-square-foot covered deck. Tiffany said the applicants obtained additional water rights from Weber Basin Water and received septic approval for the new septic system; the accessory dwelling will use the existing well.
Commissioners asked whether building envelopes recorded on the subdivision plat would be enforced; Tiffany clarified county staff enforce the plat but do not enforce private covenants and restrictions (CC&Rs) unless those items are recorded on the plat. A commissioner asked whether the structure was within plat setbacks and Tiffany confirmed it is outside recorded right-of-ways and meets code-required setbacks.
No public comments were offered. A motion to approve the CUP and final site plan, based on the staff report's findings, conclusions of law and conditions, carried by unanimous voice vote. Staff will record the required final site plan and the applicant must meet conditions during permitting.
