The Eastern Summit County Planning Commission approved a conditional use permit and final site plan for an accessory garage with an accessory dwelling unit at 3920 North State Route 32 in Oakley.
Planner Tiffany described the parcel as a conforming, grandfathered lot in the AG-10 zone, roughly 3.26 acres. The accessory building proposed a total of 2,553 square feet, with a footprint of about 1,564 square feet and a 989-square-foot accessory dwelling unit on the upper level plus a 474-square-foot deck. Because the structure exceeds 2,000 square feet in the AG-10 zone, code requires a CUP together with a final site plan to be recorded.
The applicants initially proposed a separate access to State Route 32, but the Utah Department of Transportation (UDOT) denied that access; the proposal was revised to use the existing driveway that passes the house and existing accessory building. Tiffany said the fire district approved the revised looped driveway. Tiffany also confirmed staff had not received public comment prior to the hearing.
Commissioners asked Tiffany to clarify the “grandfathered parcel” standard under section 11-4-2; Tiffany explained a lot is grandfathered when it existed in its current configuration prior to May 6, 1996 and therefore is eligible for development despite current zoning minimums. After the public hearing (no members of the public spoke), a commissioner moved to approve the CUP and final site plan subject to findings of fact, conclusions of law and the conditions of approval in the staff report; the motion passed by voice vote with all voting members recorded as aye.
Staff will record the final site plan and the applicant must meet conditions required during permitting.
