The Eastern Summit County Planning Commission approved a conditional use permit and final site plan for an accessory building with an accessory dwelling unit at 3920 North State Route 32, a 3.26-acre parcel in the AG-10 zone.
Planner Tiffany summarized the proposal as a 2,553-square-foot accessory building with a 989-square-foot upper-level accessory dwelling unit and a 474-square-foot deck. Tiffany said the parcel is a "grandfathered" conforming lot that existed in its current configuration before a 1996 code change; that status makes it eligible for development despite not meeting the current 1 unit per 10 acres standard. The accessory building footprint measures about 1,564 square feet.
The applicant had originally proposed a separate driveway off State Route 32 but UDOT denied the new access; the plan therefore was revised to use the existing driveway that serves the house and barn. Tiffany said both the fire district and the health department have approved aspects of the project: the fire district approved the revised driveway location for emergency access, and the proposed septic system received health department approval. No public comments were received during the hearing.
A commissioner moved to approve the conditional use permit and final site plan "pursuant to the findings of facts, conclusions of law, and conditions of approval found in the staff report." The motion carried on a unanimous roll-call.
Staff will record the final site plan and issue the building permit after the applicant satisfies any remaining conditions.
