Magistrate gives 2402 Oleander owner 45 days to repair exterior code violations

A special magistrate on June 4 found that the property at 2402 Oleander Boulevard violated multiple city and housing maintenance codes and ordered the property owner to make repairs within 45 days.

Code enforcement officer Heather Dubevic presented case CE2025-111, listing violations including IPMC 304.1 (exterior structure), IPMC 304.13 (window, skylight and door frame), IPMC 304.2 (protective treatment), IPMC 304.3 (address identification), and IPMC 304.7 (roofs and drainage). The officer submitted photographs dated Feb. 10, May 22 and June 2 as evidence.

Property representatives Nicholas and Pamela Kapsis were listed on the notice. The owner told the magistrate the windows had been replaced, outside storage issues were resolved and permits had been applied for the removal of a shed and for debris removal. He said some repairs were in progress and that he planned to meet with the code officer to review remaining items.

The magistrate found a violation and ordered that the owner: pressure wash and paint discolored and peeling exterior areas; repair or replace missing and broken siding; repair or replace broken and missing windows; repair the sagging and deteriorating shed roof and fascia; obtain any necessary permits and comply with permit conditions. The owner was given 45 days to comply. Failure to comply will subject the property to a $100 per day fine. The magistrate noted that the owner has 30 days to appeal the decision.

Officer Dubevic said some items did not require a permit while others likely would. The magistrate encouraged the owner to cooperate with the building department for permit approvals and said extensions could be considered if necessary.
