Planning Commission approves county land-development code language for waste control following FDEP suggestion

The Clay County Planning Commission on June 3 approved a staff-proposed amendment to the county Land Development Code to add "waste control" language provided by the Florida Department of Environmental Protection (FDEP).
Why it matters: staff said the language was recommended to address stormwater and construction-waste practices after FDEP reviewed the county's stormwater program. The addition clarifies permitted handling of construction waste and standardizes language across the code.
Jenny Bridal, the county zoning chief, presented the amendment and told the commission the proposed text was taken from FDEP and that the change also includes minor consistency edits across Article 2 and Article 8 of the Land Development Code. "Staff recommends approval of this language, which again is straight from FDEP," Bridal said.
County Engineer Richard Smith answered a commissioner question about concrete washout practices. Smith described common field practice: contractors should avoid washing concrete drums on-site; if on-site washout occurs it must be contained in a confined structure roughly one concrete block tall, cleaned and hauled off at project end. "The standard should be don't wash it out on-site, but they do. And if they do that, they'll have to put up a spatially one concrete block tall washout area so it doesn't go anywhere else and then clean it up and haul it off at the end of the project," Smith said. He added staff will increase enforcement of the requirement.
There were no public speakers on the item. A commissioner moved to approve staff's recommendation; another commissioner seconded. The motion passed by voice vote.
What was approved: the county adopted the proposed subsection adding "waste control" and amended cross-references in Articles 2 and 8 for consistency. Staff said the text came directly from FDEP and that county enforcement will be stepped up on washout practices.
