A public hearing on the Messick‑Dangler zone-of-annexation request was opened at the Oct. 14, 2025 Planning Commission meeting but was not decided after staff determined the item lacked proper public notice. Principal Planner Tim Laerbach told the commission that the application concerns annexing the property at 37830 Road and recommended the P2 (public, civic and institutional campus) zone; staff initially entered exhibits and presented the analysis that supported approval.
During questions a commissioner asked why the agenda listed the parcel as 6.43 acres while staff cited a 27.2‑acre parcel. Applicant representative Kim Kirk with Kim Kirkland Consulting and Development said 6.43 acres is the portion of the parcel not underwater and that neighborhood notices had been mailed; staff then verified a notice error. Laerbach stated, “Proper notice on this application was not given,” and recommended rescheduling the hearing. The commission recessed briefly and agreed to reschedule the item for Oct. 28; Laerbach noted the item’s scheduled city council hearing on Nov. 5 would not be affected.
Because the session did not take evidence or make findings on the annexation, no action was taken on the application on Oct. 14. The commission apologized to the applicant for the typographical notice error and invited the applicant to return to the rescheduled hearing with corrected notice.
