Council accepts contractor agreement to hold off replacement, will require replacement if safety problems emerge

Council considered a city manager recommendation after a contractor poured a 10-foot path where plans specified a 12-foot width at Hayden Heritage Park. City staff reported no current safety incidents on the 10-foot path but noted the intended 12-foot width was an aesthetic and design goal consistent with adjoining park entrances.

Caliber Concrete, the contractor, told staff it would sign an agreement obligating the company to replace the path with a 12-foot-wide surface within five years if safety or operational problems emerge. The city attorney will draft the form of that agreement. Council approved alternative 1 — authorizing staff to develop and execute the agreement — by roll call.

Why it matters: The action resolves a construction mismatch without immediately requiring removal and replacement, while preserving the city’s ability to require correction if future conditions warrant. Staff said the city will only pay for the as-poured concrete area (the contractor made the error); the agreement is a corrective assurance rather than a financial demand.

Council asked whether the city would be charged differently for the 10-foot pour; staff said the contractor bid and poured by unit area and that the city pays for the as-built quantity. Caliber Concrete agreed to sign the corrective agreement. The motion to develop the agreement passed on roll call.
