Council approves technical UDO text amendments and clarifies TRC attendance rules

The Town Council approved parts 2 and 3 of a package of Unified Development Ordinance (UDO) text amendments that staff described as technical corrections.
Planning staff reported that Exhibit 3.1 (rural-estate setbacks) should be corrected from 15 feet to 30 feet for the rural-estate classification, and that language restricting attendance at Technical Review Committee (TRC) meetings by invitation conflicted with the TRC's status as a public body and should be removed. Planner James Broadwell presented the recommended edits and answered council questions about when TRC discussions should be limited because of quasi-judicial (QJ) matters.
Council members raised concerns that public attendance at TRC could inadvertently expose non-expert listeners to preliminary discussions about projects that later become quasi-judicial; staff said TRC agendas should stick to items the UDO authorizes TRC to act on and that quasi-judicial evidence must be repeated into the record during formal hearings. The council approved parts 2 and 3 as presented by staff.
The motion passed by voice vote and the council found the amendments consistent with the comprehensive plan, as documented in the planning-board resolution included in the staff report.
