LAFCO approves MOU with Mendocino Coast Recreation & Park District to expedite municipal service review; district to fund MSR portion

The Mendocino Local Agency Formation Commission on Feb. 3 approved a memorandum of understanding (MOU) with the Mendocino Coast Recreation and Park District to expedite the district's municipal service review (MSR) and sphere of influence (SOI) update.
Under the MOU, the recreation district will pay for the MSR preparation and LAFCO will assume responsibility for preparing the SOI update and mapping. Staff estimated the MSR cost at between $20,000 and $25,000, depending on the analysis required; staff estimated the SOI update would cost approximately $2,500 and recommended using the commission's work‑plan contingency so no budget amendment is anticipated.
LAFCO staff told the commission the district's board approved the MOU at its Jan. 30 meeting. Hailey Felicich, district administrator, and Dave Schbach, a park district board member, joined the meeting via Zoom to answer questions and described changes in the district since its last MSR in 2008 that support an expedited review.
Commissioners asked about specific topics to be covered in the MSR, including the recent transition of CV Star operations to the City of Fort Bragg, an approximately 580‑acre annexation explored by the City of Fort Bragg for surface storage, and Bauer Park operations. Dave Schbach said the district has worked to resolve issues raised in a prior grand jury report and that financial audits and filings are now current.
Commissioner questions included liability and indemnification language; LAFCO's counsel said the MOU is a cost‑sharing agreement limited to preparing the MSR and SOI update and that indemnity provisions are typically addressed in the subsequent processing of projects rather than in a narrow cost‑sharing MOU.
A motion to accept staff's recommendation to enter the MOU was moved and seconded. The commission approved the motion by roll call: Commissioner Roden — yes; Commissioner Mahoney — yes; Commissioner Horsley — yes; Commissioner Gonzales — yes; Commissioner Klein — aye; Commissioner Ward — yes; Chair Mulhern — yes.
