The Fayetteville City Council approved a special‑use permit on Feb. 24 to reduce the required separation for an automotive wrecker/vehicle storage operation at 3424 Cumberland Road. The applicant said the property previously hosted similar commercial activity and that the proposed operations will serve public safety by clearing accident scenes and providing employment.
The council heard testimony from the applicant and reviewed site photos and surrounding property context during an evidentiary hearing. The attorney for the city reminded the council that the decision must be based on the six statutory special‑use factors. Council members reviewed those factors and voted to approve findings that the use complies with standards in section 30‑4C of the zoning ordinance, will be in harmony with the area, will not materially endanger public health or safety when developed as proposed, conforms with land‑use plans and would not substantially injure the value of adjacent property.
Council member Thompson moved to approve the special use with findings read into the record; the motion passed unanimously. The applicant said the operation will support towing and emergency cleanup and employ local residents.
Why it matters: the decision restores a commercial function on an industrially zoned parcel adjacent to residentially zoned lots but with existing commercial context; council’s approval included a review of proximity concerns and staff’s recommendation for a special‑use permit rather than a dimensional variance.
