Assembly hearing on AB1 seeks legislative repeal of obsolete Fort Mohave regulations

Representatives of the Colorado River Commission told the Assembly Government Affairs Committee on Feb. 20 that AB1 would repeal a set of obsolete regulations governing Fort Mohave Valley that remain on the books but are not enforceable under current law.
"Given the repeals of these statutes, regulations adopted by the Commission ... are obsolete and need to be repealed," Executive Director Eric Witkoski said, summarizing the history. He told the committee the commission’s regulatory authority to amend those rules was revoked after 2009 statutory changes and that Legislative action is required to remove the legacy regulations.
Witkoski traced the legislative history: Congress granted Nevada an option to purchase 15,000 acres in the Fort Mohave Valley near Laughlin, the commission adopted implementing regulations in the 1980s, and subsequent bills including SB301 (2007) and a 2009 cleanup bill removed the state agency authority that once supported those rules. The measures cited in the hearing text are the obsolete regulation blocks listed in AB1.
Committee members asked whether local water, improvement-district and infrastructure issues affect development timelines; Witkoski said those operational matters are primarily handled by other agencies (for example, Southern Nevada Water Authority) and that the commission’s role for AB1 is limited to cleanup of obsolete rules.
