County attorney and staff updates
County Counselor Brian Parker requested the commission recess into executive session to consult with counsel regarding potential litigation under the attorney-client exception to the Kansas Open Meetings Act. The commission recessed and later returned at the announced time; the chair asked that the record reflect "no binding action was taken during the executive session." The county clerk and selected staff were present for parts of the closed session to provide factual information.
Tax-foreclosure report
County staff reported the tax-foreclosure case currently covers 85 properties. Staff broke down the properties as: six owner-occupied, 10 farm/ranch with no land improvements, 63 vacant residential, two rental, three vacant abandoned and one warehouse. The total outstanding taxes sought in the foreclosure process were reported as $7,752,876 (figure given by county staff). County staff said the matter is proceeding and that the $750 guardian-ad-litem contract is the firm's anticipated flat fee for representation; any need for additional funds would require return to the commission.
