Applicant withdraws River's Edge subdivision application after city law department guidance

The planning board accepted a request to withdraw the application for the River's Edge planned residential development at addresses including 65 Nelson Ave and Addie Way after the City Law Department determined the project must first appear before the City Council for issuance of a special permit.
A letter from attorney John Gary addressed to the chairman asked that Residence First Development Corporation "withdraw at this time without prejudice" because the law department believes the special permit authority rests with the City Council. The planning board made a motion to allow the applicant to withdraw without prejudice and voted in favor; the chair announced the matter as withdrawn.
The law department noted that upon issuance of a special permit by the City Council the matter would likely return to the planning board to amend a previously issued definitive subdivision approval.
