Unidentified Speaker 2 moved that the panel recommend approval of the record plat dated 06/26/2025 (with any later revision dates) to the Board of Aldermen, subject to conditions that appropriate escrows be in place and that improvement plans be approved prior to signing and recording.
The record plat proposes easements and a 25-foot cross-access drive connecting existing workforce apartments; a technology drive will provide additional cross-access between the two developments. Unidentified Speaker 1 said the plat is being advanced so the buyer can close on the property and then proceed with costly improvement plans.
Questions centered on a note in the title commitment referencing declaration of land-use restriction covenants tied to low-income housing tax credits. Unidentified Speaker 3 said, “They will be market rate apartments,” and explained the developer is coordinating with HUD to file documentation that would remove the purchased parcel from the tax-credit agreement; the remaining apartments would stay under the existing HUD agreement until recorded changes are completed.
Commissioners also pressed on stormwater detention and ownership. Speaker 3 confirmed the plat shows a dividing line creating two separate common-ground parcels, each with its own basin (one remaining under the HUD-related property, the other under the parcel to be sold). Speaker 3 said improvement plans have been started but are not yet complete and offered to follow up with specifics on basin widths and construction responsibilities.
On conditions, Unidentified Speaker 1 and Speaker 5 advised that the city engineer, mayor, and city clerk would sign the final plat and that escrows or guarantees for landscaping, detention, sewer, and water should be executed before final signature. Speaker 5 noted this is consistent with city code, saying the guarantees and improvement plans must be approved prior to signing or recording the record plan.
The panel approved the motion by voice vote and forwarded the recommendation to the Board of Aldermen for final consideration next week. The record plat will not be recorded until required improvement plans and escrows or guarantees are in place.
