The Wallsburg Planning Commission on March 25 voted to send two proposed changes to the Wallsburg Town Development Code to the town council: a prohibition on short-term rentals (rentals of less than 30 days) within town limits, and an accessory dwelling unit (ADU) rule that would allow only internal ADUs (for example, basement or attached units) while prohibiting detached/outbuilding ADUs.
The commission presenter told the public the measures aim to "preserve rural character," limit strains on town infrastructure and public safety, and "ensure housing remains available for full‑time residents." The presenter also said commissioners had reviewed the proposals over recent weeks and were opening the hearing to public comment.
During the public comment and follow-up discussion, residents raised questions about permitting, setbacks and parking. One attendee asked whether an internal apartment requires a town permit; commissioners and staff said building permits and code inspections apply and that internal ADUs are permitted under state requirements while detached ADUs are not allowed by the draft town rule.
Commissioners and members discussed how parking rules apply if a single‑family home becomes, in effect, a two‑family dwelling because of an ADU. A participant cited town code section 520‑1011, which the group said requires two off‑street parking spaces per residential dwelling unit in some cases; members debated whether ADU language should require a specific minimum number of additional spaces or a standard phrased as "sufficient off‑street parking for the tenants of your accessory dwelling unit." One commissioner urged replacing a numeric minimum in Bullet Point J with a requirement for "sufficient" parking to accommodate tenants.
Concerns about short‑term rentals focused on noise, parties and visitors during festivals or events; speakers said the town had not received formal short‑term‑rental applications but had heard informal interest. The presenter explained the commission’s view that short‑term rentals can change the character of neighborhoods and make long‑term housing scarcer.
A member moved to send the two ordinances to the town council with the adjustment that ADUs must provide sufficient off‑street parking for ADU tenants. Another member seconded the motion; members approved it by voice vote with commissioners responding "aye." The motion was recorded as passed and the public hearing adjourned at approximately 7:33 p.m.
The commission’s recommendation now goes to the Wallsburg Town Council for consideration. The draft short‑term rental ordinance would bar rentals of less than 30 days within town limits; the ADU draft would permit internal units required to meet building‑code and parking standards and would prohibit detached, external ADUs.
