Council removes sunset on Rocky Tops Landscape home-occupation exemption

Farmington City Council approved a first amendment to an agreement allowing Jonathan Miller’s Rocky Tops Landscape to operate as a home-based business without the original sunset provision.
Staff told the council the company had operated a full season without neighbor complaints and recommended removing the time limit while keeping other restrictions in place. Lyle (city staff) said the business operates adjacent to a UDOT parcel and council had previously established parameters to limit impacts.
Jonathan Miller, the business owner, described his first season and said most activity involved deliveries and off-site work rather than customer traffic at the property. Miller told the council he had disabled noisy equipment beepers and discouraged children from being on-site while machinery was operating, and that he had not received complaints. “I actually have not had a single one,” he said when asked about neighborhood concerns.
Councilmember Scott moved to approve the amendment and incorporate staff findings; Amy seconded the motion and the council approved it unanimously after council members praised the property’s upkeep and Miller’s responsiveness.
The amendment removes the sunset clause but retains existing operational conditions in the agreement; staff indicated it will continue to monitor compliance and address complaints should they arise.
