Sunset work session: city legal counsel becomes a judge; council to issue RFP for attorney services

At the end of the regular meeting council entered a work session to discuss legal services after staff announced a change in the city's counsel. Office Manager Nicole said the city's prosecutor had been appointed a judge and that Danes and Jenkins would take on prosecution duties; Dalton indicated he could assist with civil matters until a new counsel is engaged, but could not provide prosecution services.
Nicole told the council the outgoing attorney's last day was Oct. 22 and asked whether the RFP for attorney services needed any edits. Council members noted the RFP would require posting and a short window for interviews, and one member emphasized the need to have counsel available to participate in a follow-up meeting with Ascend representatives. The council asked staff to circulate the existing RFP and suggested interview panels include the council and attorney candidates.
Mayor Scott Wiggle asked staff to consolidate outstanding questions and redline comments for the Ascend development agreement so the city attorney and engineer could examine one document prior to any special meeting. Council members asked Nicole to coordinate availability with Dalton for an Oct. 17 meeting if possible and to circulate a single document so the council could prepare questions in advance.
What happens next: Staff will post and circulate the attorney-services RFP, coordinate candidate interviews and schedule a joint meeting with counsel, the engineer and Ascend representatives to resolve the outstanding development agreement redlines before bringing the item back to the council for action.
