Kaneland negotiator: proposed Sugar Grove TIF talks productive; IGA to prioritize tuition and school improvements

The board received an update on negotiations with the Village of Sugar Grove over the proposed Crown Community Development tax‑increment financing (TIF) district.

Attorney/negotiator Mr. Florey told the board he and district staff held productive remote meetings with village representatives and that he will draft an intergovernmental agreement (IGA) to maximize payments in several categories, including a tuition payment category the district identified as a priority. "The ball is in my court now to revise the intergovernmental agreement...to reflect maximizing the payments in each of these categories," Florey said.

Florey noted some development agreement items are fixed and cannot be retroactively changed (residential permits, school impact fees, land‑cash fees), but the Village committed to a 10% overall TIF surplus, of which the district would receive 70% for its portion of the tax bill. He said the Village agreed to consider paying for school improvements as TIF‑eligible costs before declaring additional surplus above the 10%.

Florey said the draft IGA will include mutual releases — for example, the district's pending PAC challenge to the TIF creation would be dropped — but clarified that releases would not prevent the district from challenging errors in TIF administration. Board members acknowledged the progress while noting there is no guarantee until final language is reviewed and approved.

The board did not vote on the matter; Florey said he will circulate draft IGA language for the board and staff to review ahead of a future meeting.
