Planning board approves two-lot ANR at 42 Lackey Street subject to recorded confirmation deed

The Planning Board approved an ANR (approval-not-required) plan for two lots at 42 Lackey Street on Nov. 19, 2024, subject to a recorded confirmation deed being filed before issuance of a building permit.
Michael Grossworth of WDA Design Group presented the ANR and said the two lots comply with the Highway Business zoning district standards for single-family residential lots (minimum frontage and lot area). Owner Chuck Lane said the parcel passed through probate and that, on legal advice, a confirmation deed can be prepared; he said he and his sister are prepared to execute the deed so title will be clear before construction.
Planning staff said the board can endorse the ANR while holding the condition that the confirmation deed be recorded before building permits are issued. The board voted to approve the ANR with that condition and asked the applicant to provide a recorded copy to the planning office when available.
