District Attorney counsel raised the decisive concern: the county cannot permit filming of detainees who have not given informed consent, and the contract did not guarantee that consent would be obtained before filming or provide adequate legal safeguards. The DA said, "Nobody can be filmed without their consent," and warned that airing footage of individuals who did not sign informed releases could create substantial liability for the county.
The contract included a 10-working-day review window for segments and a 20-day prior-review clause, but the DA and several commissioners said that review post-filming was insufficient to protect people who were no longer in custody at broadcast time. The Board voted to reject the proposed agreement and asked staff to communicate legal and consent requirements to outside producers should they seek to film in the future.
