Staff said legal counsel recommended a tenants‑in‑common arrangement rather than an LLC; the goal is to complete the paperwork by the first of the year so the city can make a planned $3,000,000 investment.
Staff said the agreement will include covenants, conditions and restrictions intended to keep the property as permanently open space for non‑motorized recreation such as hiking, biking, horseback riding and winter uses. The council discussed governance and staffing for the property and the need for decision‑making safeguards that require both Cache County and Wellsville City approval for material changes.
Council members moved to allow Mayor Tom Bailey to complete the agreement and to appoint Mayor Tom Bailey, Chad Lindley and Scott Wells to serve on the board (or equivalent management structure) that will oversee the property. Both motions were seconded and approved by voice vote.
Next steps: city legal staff will finalize the joint‑ownership documents and covenants, the mayor will sign the paperwork as authorized, and staff will present the completed agreement publicly to the council once it is finalized.
