Council on Dec. 2 denied a proposed land‑use change for a parcel at 304 East Highway but approved a separate rezoning request to reclassify the property from R‑2 (residential) to C‑2 (commercial).
Edward Tsai, representing the Dorothy Tsai Family Trust, introduced the request. Staff explained the application involved two separate actions: a land‑use/place‑type amendment (which staff recommended denying because the existing mixed‑use community corridor place type already accommodates C‑2 zoning) and a zoning map change. The Planning & Zoning Commission recommended denying the land‑use amendment but recommended approval of the rezoning because the new comprehensive plan effectively aligned the parcel with commercial zoning.
Council first moved to deny ordinance 2025‑51 (land‑use change); the motion carried on voice vote. The council then moved to approve ordinance 2025‑52, rezoning the property from R‑2 to C‑2; that motion likewise carried.
Staff said the case results from an artifact of the prior comprehensive plan; the newly adopted plan had already shifted the place type to one compatible with commercial zoning, and the rezoning was consistent with the pattern of C‑2 zoning in the surrounding area. There were no sustained public comments recorded that altered staff recommendations.
With council approval of the rezoning, the parcel at 304 East Highway will be subject to C‑2 standards and any applicable site‑plan review moving forward.
