Planning commission defers Sport & Health Drive townhouse rezoning after residents cite safety, flooding and access problems

The Planning Commission voted to defer action on a request to rezone 7.8 acres currently occupied by the former Sport & Health facility in the Occoquan area after a turnout of neighbors raised safety, flooding and access concerns.
Applicant Austin Haines (Bean, Kenny & Corman) and developer Garrett Ertle presented a revised plan that replaced a higher‑density multifamily concept with a single‑owner, professionally managed rental townhome community of 80 units. The applicant said the design emphasizes open space (about 55% or more compared with the minimum) and includes noise mitigation measures and high‑STC windows for units facing I‑95.
Residents who live along Devil’s Reach Road described repeated, unresolved infrastructure and public‑safety problems, including an out‑of‑service fire hydrant, recurring flooding and a narrow two‑lane VDOT road that they say cannot safely absorb construction traffic or the daily trips from the new homes. Several speakers said a prior fire at the Sport & Health facility had impeded residents’ emergency access.
Staff confirmed the application had been reviewed by multiple county agencies and that the applicant had submitted a traffic impact analysis, noise study and other technical reports; the case planner also noted the applicant is proposing 10% of units as affordable dwelling units and sustainability features such as EV capability and energy‑star qualified homes.
Commissioners spent extended time questioning the applicant about road width, sidewalks, stormwater, parking and whether the neighborhood had been reached effectively. The applicant agreed to additional outreach, further meetings with VDOT and neighborhood representatives, and to return with additional documentation. The commission voted to defer the rezoning to a date certain, May 28, 2025, to allow those tasks to proceed.
Next steps: the applicant said it would meet again with neighbors and VDOT and return to the Planning Commission at the May 28 meeting with follow‑up materials.
