Frisco council authorizes limited disclosure to defend Zito lawsuit; vote 6–0

The Frisco City Council voted unanimously Sept. 2 to authorize the city manager to provide counsel for the city in the matter of Jesse Zito v. City of Frisco and to produce documents the city manager deems necessary to defend the lawsuit. The motion, read and moved by Councilmember John, specified that disclosure may include material protected by attorney-client privilege but that any waiver would be limited to documents relevant to the case and only to the extent necessary to defend the allegations.
John read the motion into the record and the council adopted it by voice vote, 6–0. Councilmember Laura seconded the motion. The mayor reported no other immediate action resulting from the executive session.
The action followed an executive session in which council said it had received legal advice under Texas Government Code Section 551.071 and deliberated related matters under Sections 551.072 and 551.087. Council’s motion delegates limited discretion to the city manager to disclose privileged materials to outside parties only as necessary to respond to the lawsuit.
What’s next: Staff did not announce further public steps at the meeting. Any future filings, disclosures or settlements would appear in subsequent public records and council agendas.
