Commission approves Cafe Racer special exceptions with exterior-plan condition after debate over parking and design

Casey Krzyk, planning-and-zoning staff, introduced a request for two special exceptions for 541 East College Avenue and the adjacent 170 Commerce Drive parcel: raise the maximum parking from 19 to 30 spaces and reduce the minimum building height from 24 feet to 17 (with a 15-foot low point).
Michelle Battle, counsel for the petitioner, described site constraints from surrounding narrow streets and the lack of safe on-street parking nearby; she said employees arrive as early as 4 a.m. to prepare food and argued additional on-site spaces are needed for staff safety and operational needs. "We have staff on-site at 4 in the morning because they are making food," said Brad Gallant of Cafe Racer.
The Development Authority of Decatur (DDA) had offered conditional support, asking that any city approvals be based on plans "substantially similar" to the exhibits presented (placement, facade and site plan). Commissioners debated the request at length: some praised the building’s corner activation and revised architecture while others warned that repeatedly approving site-specific parking exceptions could undercut the larger East Decatur Station vision and urged exploring communal parking solutions.
Applicants said the site is small and irregular after years as an auto lot and that redevelopment offers an opportunity to reduce impervious surface and activate the corner with pedestrian-friendly design. They also said environmental testing on the former service-station parcel has been carried out and they are confident remediation and redevelopment are feasible.
After discussion, the commission moved to approve ordinance O-25-Z-CC with an amendment adding the DDA’s condition that approved plans be substantially similar to the exterior/site exhibits shown in the application; commissioners took a roll-call vote and adopted the ordinance. The motion included a clarification that the substantial-similarity condition would apply to exterior façade and site plan elements while allowing interior layout flexibility as design and cost considerations evolve.
The commission directed staff to ensure final permitting verifies parking, circulation, and ADA compliance during the building-permit review and to consider the longer-term parking strategy for East Decatur Station in coordination with the DDA and future planning work.
