At the end of the meeting the Lucas City Planning & Zoning Commission reviewed two Texas Attorney General opinions concerning plats and professional seals.
The chair introduced Attorney General opinions KP‑0349 and KP‑0409 and told commissioners that when they deny or conditionally approve a plat they must “call out specifically in the ordinance, county regulation, state law, whatever specifically why you're conditionally approving or disapproving the request and have that put in the minutes of the meeting.” The chair said the requirement is to ensure that denials or conditional approvals are tied to specific legal or technical deficiencies rather than personal preference.
Staff added that after any denial or conditional approval, the city sends a memorandum to the applicant that lists the exact code sections and the steps needed to remove conditions and finalize the plat. Staff said the memorandum practice is standard and intended to make the code citations clear to applicants and reduce misunderstandings.
Commissioners were reminded to verify that plats are signed and sealed by the appropriate professional (licensed engineer or licensed surveyor) and that the required signatures and seals are present on submitted documents. The commission did not take formal action on these items; the discussion was procedural guidance for future plat reviews.
